Legal office to hold "will week" Published Nov. 4, 2009 By Capt. Mike Kirkland 5th Bomb Wing Staff Judge Advocate office MINOT AIR FORCE BASE, N.D. -- Have you had trouble making it to legal assistance? Have you been putting off getting a Will done? Have you gotten married, divorced, had kids, or had other life changing events? Do you just want a Will? The Legal Office will be having a "Will Week" Nov. 30 to Dec. 4. In order to help assist the Minot AFB military community, appointments will be available Monday, Wednesday and Friday from 9 a.m. to 3 p.m. and Tuesday and Thursday from 8 a.m. to 3 p.m. During this week there will be no walk-in legal assistance except for notaries and power of attorneys. Regular legal assistance hours will resume the following week. Do I need a will? That is a question only you can answer. All states provide for the distribution of a person's property and care for minor children when he or she passes away. This distribution of property and care of children varies between every state. A Will is a document that states expressly who should receive your property and take care of your children if you should pass away. A military Will is valid in all fifty states and U.S. territories. So it is up to you to make a determination of whether you need a Will. I already have a will do I need a new one? Again, that is a question only you can answer. A Will is valid until properly revoked. If you already have a Will, that Will is still good and will be until you pass away. A new Will is appropriate when an event occurs that makes a provision in your Will obsolete. Such occurrences are the death or incapacity of a beneficiary, executor/personal representative, or a guardian for your children. If this happens, those provisions of your Will will be governed by state law, not your choice. If this has occurred it may be time to get a new Will To schedule an appointment call 723-3026.
