Courts-Martial: Two Airmen convicted for aggravated assault Published Feb. 29, 2012 Base Legal Office MINOT AIR FORCE BASE, N.D. -- Two Airmen were recently convicted and sentenced for aggravated sexual assault of underage girls and related crimes. Both men claimed the victims consented to the sexual acts. However, under the Uniform Code of Military Justice, individuals younger than 16 years of age cannot legally give consent to sexual acts of any kind. Similarly, under North Dakota law, an individual younger than 15 years of age cannot give legal consent to sexual acts. It is also illegal in North Dakota for an adult to engage in sexual activities with a minor between the ages of 15 and 17 if the adult is three or more years older than the minor. A violation of any of these laws may result in criminal prosecution, conviction, and a requirement to register as a sex offender. U.S. vs Airman Trevor Tucker On Jan. 17, a General Court-Martial was convened to hear the case of United States versus Airman Trevor Tucker, 5th Aircraft Maintenance Squadron. Tucker was charged with violating Article 120 of the UCMJ by engaging in sexual intercourse with two child victims between the ages of 12 and 16 years of age. Tucker was also charged with violating Article 134 of the UCMJ by knowingly possessing a photograph of a minor engaging in sexually explicit conduct. Tucker was found guilty and sentenced to 18 months confinement, reduction to E-1, forfeiture of all pay and allowances for 18 months, and a dishonorable discharge. U.S. vs Senior Airman Andrew Felix On Jan. 23, a General Court-Martial was convened to hear the case of United States versus Senior Airman Andrew Felix, 91st Missile Maintenance Squadron. Felix was charged with violating Article 120 of the UCMJ by engaging in sexual intercourse with a child between the ages of 12 and 16 years of age. Felix was found guilty and sentenced to 11 months confinement, reduction to E-1, forfeiture of all pay and allowances for 11 months, and a bad conduct discharge.
