New DEA Regulation The Drug Enforcement Agency, the federal administrative agency responsible for coordinating drug enforcement efforts throughout the United States is in the process of promulgating a new rule regarding the drug Spice. The new rule, which carries the weight of federal law, makes the chemical components used to produce the drug Spice Schedule I controlled substances. The proposed rule is currently in the comment phase of administrative rule-making, and will become law effective in January 2011. Spice, and its chemical components, are already prohibited by North Dakota state law, as well as Air Force policy. The new DEA rule reinforces this prohibition and will encompass states that do not currently prohibit Spice. Under the new rule, Spice will be illegal throughout the United States. Airmen should be aware that the Air Force prosecutes Spice cases just as it prosecutes any other cases of drug abuse, possession, and or distribution. There are serious consequences for violating this standard, including the possibility of trial by court-martial, federal conviction, and confinement.
